Introduction

Potify operates as a DAO (Decentralised Autonomous Organisation), functioning as a community-led entity without a central authority. It operates autonomously and transparently, with smart contracts establishing foundational rules and executing agreed-upon decisions. Proposals, voting processes, and the underlying code can be publicly audited at any time.

These Terms of Service apply to the use of the Potify crowdfarming platform located at www.mypotify.com, its subdomains, and the services provided therein. The website, subdomains, and services are owned by Potify and its community, operating without a central authority and headquartered at www.mypotify.com.

These Terms outline the operation of mypotify.com and the rights and obligations of all involved parties. By using the website and/or services, you agree to abide by these Terms of Service; if you do not agree, refrain from using the website and/or services.

1.1 Definitions

The "Agreement" refers to the acceptance of the Terms of Service outlined by Potify.

The Potify website, its subdomains, applications, and/or services provided by www.mypotify.com are collectively referred to as the "Platform" within these Terms of Service.

Individuals or entities using the Platform under these Terms of Service are referred to as "Users."

1.2 Parties of the Agreement
The Agreement is between Potify and the User.

Potify is the legal entity responsible for the relationship with the User and holds the rights and obligations related to the Platform.

Changes in Terms of Service

2.1 Potify reserves the right, at its sole discretion, to modify, add, or remove provisions from these Terms of Service at any time. Users are responsible for periodically reviewing these Terms for changes without additional notifications. The current version of the Terms is available at https://mypotify.com/terms. By using the Platform after updates to the Terms have been published, Users accept and agree to these changes. Only upon agreement and compliance with these Terms will mypotify.com grant Users personal, non-exclusive, non-transferable, limited access to enter and use the Platform.

Registration

  • 3.1 The Potify Platform is intended exclusively for Users aged 21 and above. Access or use of the Platform by individuals under 21 is strictly prohibited. By accessing or using the Platform, you confirm that you are over 21 years old.
  • 3.2 Registration requires personal information, a valid email address (which serves as the username and method of identification for your account), and a password.
  • 3.3 Potify may request Personally Identifiable Information (PII) and/or financial details from Users for KYC (Know Your Customer) and/or AML (Anti-Money Laundering) procedures. Potify reserves the right to impose restrictions on User accounts based on the provided information.
  • 3.4 Users must ensure that all information provided to Potify is true, complete, not misleading, and relevant.
  • 3.5 In case of account access issues, Potify may require Users to provide certain data, including Personally Identifiable Information, to verify account ownership. Verification methods may include providing identity cards, proof of residence, phone number/email confirmation, and identifiable activity on the Platform.
  • 3.6 Potify provides growing management services to Users through partners and experts operating in suitable territories with necessary technical and climatic requirements, including all licenses. Specific program conditions are published on the Platform and within these Terms of Service.
  • 3.7 All contracts offered to Users are published on the Platform. Contract prices and specifications are subject to change without prior notice.
  • 3.8 Potify creates and offers contracts through the mypotify.com web platform.
  • 3.9 Technically, a User's order is a request for a contract from Potify and is not considered an Agreement until the order is paid for and confirmed. Until then, the order is pending, and Potify reserves the right to decline payment.
  • 3.10 Order confirmation is provided via email and includes the estimated contract date, also visible in the User's account on the Platform. A confirmed contract date follows in a subsequent email. Potify cannot estimate the contract date until confirmation is received from production partners.

Orders / Payments

  • 4.1Order Time Frame
    When placing orders for plants and cultivation management services, it is noted that services and plants are provided by licensed cultivation partners.
  • 4.2Payment for Orders
    Acceptance of a User's order is contingent upon payment through the Platform. Acceptable payment forms include cryptocurrency.
  • 4.3Consent by Click
    By clicking "Buy Now" at the end of the order process, Users consent to these Terms of Service and any provided terms and conditions.
  • 4.4Orders
    Submitting an order is an application for a contract, subject to approval from Potify. The order is not considered a contract until payment and approval.
  • 4.5Purchase Reference Number
    The confirmation email contains a unique purchase reference number, to be used in subsequent correspondence with Potify.
  • 4.6Duplicate Revenue
    Sales revenue from harvests and sales through Partners are immediately paid out to Users upon clearance in the Potify account.
  • To duplicate revenue or generate additional revenue, Users must create a new order following these terms and Platform rules.
  • 4.7Potify Guarantee
    Potify strives to ensure the farmer's income occurs and funds are delivered to the User's account promptly.
  • Sales revenue is contingent on successful harvesting and plant sales. Potify partially covers risks of unsatisfactory harvests with reserve plants grown through a separate arrangement with Partners.
  • 4.8Age Restriction
    Orders by individuals under 21 years old will not be accepted and will be terminated.

Obligations

  • 5.1 Users agree to comply with all applicable laws, rules, and these Terms of Service related to Website and Service usage.
  • 5.2 Users agree not to misinform or misrepresent themselves in any relation to Potify.
  • 5.3 Users shall not abuse campaigns, discounts, referral bonuses, and/or referral systems provided by Potify and its partners.
  • 5.4 Users shall not use or allow the use of solutions to hide Internet traffic and IP addresses, including Proxy, Tor, VPN, or any other means.
  • 5.5 Exploiting errors/bugs in the Website or Service design for personal/commercial gain, or to violate/destabilize the Service/Website, is strictly prohibited. Users encountering such errors accidentally should report them to support.
  • 5.6 Potify provides Users a limited license for personal access/use of the Website/Application but not for downloading/changing any part without written consent. Resale/commercial use, product list collection, derivative use, downloading/copying account information for another seller's benefit, or using data collection/extraction tools is prohibited.
  • 5.7 Reproduction/duplication/sale/use of Website/Application or its contents for commercial purposes without written consent is prohibited.
  • 5.8 Users are not allowed to use cropping methods to attach Potify trademarks/logos or employ meta tags/hidden text with names/trademarks/logos without written consent. Unauthorized use invalidates the license granted by Potify.
  • 5.9 Using Potify logos/graphics/trademarks as part of a link without written consent is prohibited.

Privacy Policy

  • 6.1 This Policy outlines how Potify processes personal information received from or provided by Users.
  • 6.2 Transparency and accessible information about personal data usage are crucial aspects of data protection regulations.
  • 6.3 This Privacy Policy applies to information collected when Users access/use Potify products/services or interact with Potify in different ways.
  • 6.4 By visiting the website, Users agree to the methods described in this policy.
  • 6.5 Potify website content may contain links to affiliate networks/advertisers with their own privacy policies. Potify is not responsible for these policies.

Customer Complaints

"Support" or "Support Service" refers to Potify's technical support service, accessible via email and Telegram channels provided on the Potify website/user account section at https://mypotify.com/growroom.
